By accessing or using the Sunday Night Futures website (sundaynightfutures.com), our email communications, or any related services (collectively, the “Service”) provided by Sunday Night Futures LLC (“SNF,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2.Description of Service
SNF provides market intelligence, analysis, AI-generated briefs, news aggregation, and related content covering U.S. equities, futures, cryptocurrencies, and macro topics. The Service includes both free and paid subscription tiers and may include email newsletters, web access, and embedded charts.

SNF is not a registered investment adviser, broker-dealer, or financial planner. We do not provide personalized recommendations and do not consider your financial situation, objectives, or risk tolerance. Trading and investing involve substantial risk of loss, including total loss of capital. Past performance does not guarantee future results.

4.Market Data Disclaimer
Market data, prices, charts, and quotes are provided by third-party sources (including but not limited to Polygon.io and TradingView) and may be delayed, inaccurate, or incomplete. SNF does not guarantee the accuracy, timeliness, or completeness of any data and is not responsible for losses resulting from reliance on it.
5.AI-Generated Content
Portions of the Service—including briefs, summaries, and news write-ups—are generated or assisted by proprietary AI analysis engines and large language models. AI output may contain errors, omissions, or fabrications. You should independently verify any factual claim before acting on it. SNF makes no warranty regarding AI-generated content.
6.User Conduct
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any account, system, or data; (c) scrape, redistribute, resell, or republish content without written permission; (d) interfere with the operation of the Service; or (e) misrepresent your identity or affiliation.
7.Intellectual Property
All content, branding, logos, and trademarks on the Service—including the “Sunday Night Futures” name, the SNF logo, and associated marks—are the property of Sunday Night Futures LLC. Relevant trademark filings with the United States Patent and Trademark Office include USPTO Serial No. 99812698 and USPTO Serial No. 99837855. You may not copy, modify, or distribute our content without written authorization.
8.Email Communications
By providing your email address, you consent to receive transactional and marketing email from SNF, including newsletters and product updates. You may unsubscribe at any time using the link at the bottom of any email. Transactional messages (such as account or billing notices) may continue while your account is active.
9.Subscriptions, Free Trials, Billing & Cancellation
9.1 Paid Subscriptions. SNF offers paid subscription tiers (currently “SNF Alerts” and “SNF Pro”) billed on a recurring monthly basis. By subscribing, you authorize Sunday Night Futures LLC, through our third-party payment processor (Stripe), to charge your payment method the applicable recurring fee until you cancel.
9.2 Free Trial. Certain subscriptions include a 7-day free trial. To start a trial you must provide a valid payment method. UNLESS YOU CANCEL BEFORE THE TRIAL ENDS, YOUR SUBSCRIPTION WILL AUTOMATICALLY CONVERT TO A PAID SUBSCRIPTION AND YOUR PAYMENT METHOD WILL BE CHARGED THE THEN-CURRENT MONTHLY FEE. The trial begins on the date you sign up and ends 7 calendar days later.
9.3 Automatic Renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current rate, and your payment method will be charged automatically, unless you cancel before the renewal date. Subscription fees may change; we will provide notice of any price change before it takes effect, and continued use after the change constitutes acceptance of the new price.
9.4 Cancellation. You may cancel at any time through the Stripe customer portal, accessible from your account, or by contacting us at contact@sundaynightfutures.com. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date. To avoid being charged for a renewal or for trial conversion, you must cancel before the renewal or trial-end date.
9.5 Refunds. Except where required by law, subscription fees are non-refundable, and we do not provide refunds or credits for partial billing periods, unused time, or features not used. We may, at our sole discretion, offer a refund in individual cases.
9.6 Failed Payments. If a charge fails (including at the end of a free trial), we may suspend or terminate your access to paid features immediately. You may resubscribe at any time.
9.7 Changes to Plans. We may add, modify, discontinue, or change the price of any subscription tier. Material changes affecting your active subscription will be communicated to you in advance.
10.Third-Party Links
The Service may link to third-party websites or services. SNF does not control and is not responsible for the content, policies, or practices of any third party. Your use of third-party services is at your own risk and subject to their terms.
11.Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SNF, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING FROM YOUR USE OF THE SERVICE—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO SNF IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US$100), WHICHEVER IS GREATER.
12.Indemnification
You agree to indemnify, defend, and hold harmless SNF and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms, your use of the Service, or your violation of any law or third-party right.
13.Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
14.Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Nassau County, New York for any dispute not subject to arbitration.
15.Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, the dispute shall be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Nassau County, New York. You waive any right to a jury trial or to participate in a class action.
16.Changes to Terms
SNF may modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
